JAYAPURA, Desapenari.id – Kepolisian Daerah (Polda) Papua akhirnya berhasil membongkar sebuah kasus penambangan emas ilegal yang sangat merugikan negara. Dengan kata lain, aktivitas yang mereka jalankan benar-benar ilegal dan sama sekali tidak memiliki payung hukum.
Setelah dilakukan penyelidikan lebih lanjut, terungkap fakta yang cukup mencengangkan. Ternyata, kelompok ini telah melakukan penambangan emas secara ilegal dalam kurun waktu tertentu. Bahkan, mereka sudah berhasil mengumpulkan emas sebanyak 257 gram dari kegiatan haram tersebut! Yang paling parah, motif utama dari semua tindak pidana ini adalah untuk menghindari kewajiban membayar pajak kepada negara. Tentu saja, tindakan ini sangat merugikan pendapatan negara.
Lalu, siapakah sebenarnya para tersangka yang berani main-main dengan kedaulatan hukum Indonesia ini? Polda Papua pun membeberkan identitas dan peran mereka satu per satu secara detail. Pertama, ada AAM (47), seorang Warga Negara Indonesia (WNI) yang menjabat sebagai Direktur PT Saveree Gading International Group. Pria ini diduga kuat berperan sebagai penyedia modal dan semua sarana yang digunakan untuk menambang.
Kemudian, tersangka berikutnya adalah LHS (46), yang juga merupakan WNI. Dalam operasi ilegal ini, ia bertugas sebagai penerjemah sekaligus koordinator untuk urusan pembayaran gaji karyawan. Selanjutnya, barulah kita masuk kepada para tersangka WNA China. CL (46) berperan sebagai teknisi mesin survei dan juga pelatih bagi karyawan lokal.
Lalu, ada WCD (60) yang bertugas sebagai teknisi listrik di lokasi tambang. Selain itu, CHT (40) diduga berperan sebagai perantara yang menjembatani para investor dari China. Terakhir, ada CD (41) yang merupakan investor lapangan yang langsung mengawasi operasi.
Tak hanya berhasil menangkap para tersangka, penyidik dari Polda Papua juga berhasil menyita banyak barang bukti yang sangat kuat. Barang bukti yang berhasil diamankan antara lain satu unit alat berat merek Caterpillar model PC 200, berbagai dokumen perusahaan yang penting, serta paspor dan Kartu Tanda Penduduk (KTP) milik semua tersangka.
Terkait ancaman hukuman, Kombes Pol Era Edhinata menjelaskan bahwa semua pelaku akan dijerat dengan Pasal 158 juncto Pasal 35 ayat (3) huruf a UU No. 3 Tahun 2020 tentang Pertambangan Mineral dan Batubara. Tak hanya itu, mereka juga terkena Pasal 55 ayat (1) KUHP. Dengan demikian, ancaman hukuman maksimal yang bisa mereka terima adalah 5 tahun penjara dan denda yang sungguh fantastis, yaitu hingga Rp 100 miliar!
Di akhir pernyataannya, Era menegaskan dengan sangat tegas bahwa Polda Papua tidak akan pernah berhenti untuk menindak tegas semua praktik tambang ilegal.
