JAKARTA, Desapenari.id – Astatantica Belly Stanio, perwakilan Tim Advokasi untuk Demokrasi (TAUD), membongkar fakta mengejutkan. Cho Yong Gi, tenaga medis yang kini berstatus tersangka dalam demo buruh di Patung Kuda, Jakarta Pusat, ternyata sedang sakit saat menjalani pemeriksaan polisi.
Belly menegaskan, Cho mengalami tekanan psikologis hebat. Bahkan, ia sempat mual dan muntah saat ditangkap. Namun, polisi tetap memaksakan pemeriksaan meski kondisi fisiknya tidak memungkinkan.
“Cho Yong Gi jelas dalam keadaan tertekan. Badannya lemas, mual, sampai muntah saat ditangkap. Tapi, polisi malah melanjutkan interogasi. Alhasil, proses pemeriksaan justru membuatnya muntah lagi,” tegas Belly kepada Kompas.com, Rabu (4/6/2025).
Kesehatan vs Proses Hukum: Mana yang Lebih Penting?
Belly menilai, kondisi kesehatan Cho seharusnya jadi alasan kuat untuk menunda pemeriksaan. Polisi harus mengutamakan hak kesehatan dan hukum klien tersebut.
“Pengacara kami sudah meminta penundaan pemeriksaan agar klien bisa pulih dulu. Ini soal hak dasar,” tambahnya.
Selain itu, Belly meluruskan kesalahan informasi yang beredar. Cho menandatangani Berita Acara Klarifikasi (BAK), bukan Berita Acara Pemeriksaan (BAP). Tim hukum mencabut beberapa keterangan dalam BAK karena polisi mengambilnya saat Cho dalam kondisi fisik dan mental tidak stabil.
Polisi Akui Tangkap Tim Medis & Paralegal
Sebelumnya, Kabid Humas Polda Metro Jaya, Kombes Ade Ary Syam Indradi, mengakui fakta mengejutkan. Dari 14 orang yang diamankan dalam demo buruh 1 Mei 2025 di depan Gedung DPR/MPR RI, empat di antaranya bukan pengunjuk rasa.
“Benar, ada dua kelompok yang kami amankan. Sepuluh orang adalah massa aksi, sementara empat lainnya dari tim paralegal dan medis,” jelas Ade Ary, Selasa (2/6/2025).
Polisi beralasan, tim medis dan paralegal itu tidak menuruti perintah saat aksi.
“Mereka dianggap sengaja tidak segera meninggalkan lokasi meski sudah diperintah tiga kali oleh petugas. Ini melanggar Pasal 216 dan 218 KUHP,” tegas Ade Ary.
Protes & Pertanyaan Publik: Apakah Penanganan Sudah Proporsional?
Kasus ini memantik pertanyaan publik. Apakah polisi sudah bertindak proporsional? Bagaimana mungkin aparat justru mengkriminalisasi tenaga medis yang bertugas membantu korban?
Belly dan timnya berencana mengajukan keberatan hukum. Mereka menilai, proses penangkapan dan pemeriksaan terhadap Cho sarat dengan pelanggaran prosedur.
“Kami akan terus pantau perkembangan kasus ini. Tidak boleh ada intimidasi terhadap relawan kemanusiaan,” tegasnya.
Sementara itu, publik menunggu klarifikasi lebih lanjut dari kepolisian. Apakah ada alasan kuat di balik penangkapan tim medis, atau ini sekadar upaya kriminalisasi terhadap pihak yang kritis?
