Jakarta, desapenari.id – Anggota Komisi II DPR RI, Muhammad Khozin, menilai putusan Mahkamah Konstitusi (MK) yang memisahkan pemilu nasional dan lokal dengan jeda 2,5 tahun sebagai langkah paradoks. Padahal sebelumnya, MK justru memberikan enam opsi model keserentakan pemilu. Kini, MK malah membatasi hanya pada satu model. Khozin menegaskan, seharusnya MK konsisten dengan putusan lama yang memberi kebebasan kepada pembentuk undang-undang (UU) untuk merumuskan model keserentakan dalam UU Pemilu.
“Faktanya, UU Pemilu belum diubah sejak putusan MK No. 55/PUU-XVII/2019. Namun, hal ini tak boleh jadi alasan bagi MK untuk mengambil alih kewenangan DPR. Soal model keserentakan pemilu sepenuhnya wewenang pembentuk UU,” tegas Khozin di Jakarta, Jumat (26/6).
MK Dinilai Melampaui Kewenangan
Khozin menggarisbawahi pertimbangan hukum dalam Putusan MK No. 55/PUU-XVII/2019, yang secara tegas menyatakan bahwa MK tidak berhak menentukan model keserentakan pemilu. “Putusan 55 sudah jelas—urusan model keserentakan bukan domain MK. Tapi anehnya, sekarang MK malah memutuskan sendiri,” ujarnya.

Ia menyayangkan putusan terbaru MK yang justru bertolak belakang dengan putusan sebelumnya. Menurutnya, dampaknya bakal luas: mulai dari pelemahan kewenangan DPR dan Presiden sebagai pembentuk UU, masalah konstitusionalitas penyelenggaraan pemilu, hingga persoalan teknis di lapangan.
“Sayangnya, MK hanya melihat dari satu sudut pandang. Di sinilah pentingnya hakim yang bersikap negarawan—harus punya visi jauh ke depan, bukan sekadar memutus tanpa mempertimbangkan konsekuensinya,” kritik Khozin.
Meski kecewa, Khozin memastikan DPR akan menjadikan putusan MK ini sebagai bahan pertimbangan utama dalam perubahan UU Pemilu yang rencananya segera dibahas. “Kami akan lakukan rekayasa konstitusional untuk mendesain ulang sistem kepemiluan di Indonesia,” ucapnya.
Ia mengingatkan, dalam putusan sebelumnya, MK justru meminta pembentuk UU untuk melakukan rekayasa konstitusional melalui revisi UU Pemilu. “Jadi, seharusnya MK tidak perlu turun tangan menentukan modelnya,” tambahnya.
Putusan MK: Pemilu Nasional dan Daerah Dipisah dengan Jeda 2-2,5 Tahun
Sebelumnya, MK memutuskan pemilu nasional dan daerah harus dipisah dengan jeda minimal dua tahun atau maksimal 2,5 tahun. Pemilu nasional mencakup pemilihan anggota DPR, DPD, serta presiden dan wakil presiden. Sementara pemilu daerah meliputi pemilihan anggota DPRD provinsi/kabupaten/kota serta kepala daerah dan wakilnya.
“Mengabulkan permohonan pemohon untuk sebagian,” ujar Ketua MK Suhartoyo saat membacakan amar Putusan Nomor 135/PUU-XXII/2024 di Ruang Sidang Pleno MK, Jakarta, Kamis (26/6).
Pemisahan pemilu ini berpotensi memicu kelelahan politik di masyarakat. Bayangkan, dalam kurun 2,5 tahun, rakyat harus dua kali datang ke TPS. Biaya politik juga bakal membengkak, baik bagi negara maupun peserta pemilu.
Di sisi lain, pemisahan ini bisa memberi ruang lebih luas bagi pemilih untuk fokus memilih calon di tingkat nasional dan daerah secara terpisah. Namun, tanpa sinkronisasi kebijakan yang baik, justru bisa memicu ketidakstabilan politik.
DPR dan pemerintah kini punya pekerjaan rumah besar: merancang UU Pemilu yang mengakomodir putusan MK tanpa mengabaikan prinsip konstitusional. Proses ini harus transparan dan melibatkan partisipasi publik agar hasilnya optimal.
Sementara itu, MK diharapkan lebih bijak dalam mengambil putusan. Jangan sampai keputusan yang seharusnya memperkuat demokrasi malah jadi bumerang bagi stabilitas politik Indonesia.
Putusan MK ini ibarat pisau bermata dua. Di satu sisi, bisa memberi ruang evaluasi penyelenggaraan pemilu. Di sisi lain, berisiko memicu kompleksitas baru. DPR, pemerintah, dan seluruh stakeholders harus bergerak cepat merumuskan solusi terbaik agar pemilu tetap menjadi pesta demokrasi yang berkualitas.
