Keempat fraud tersebut meliputi side streaming (penyimpangan penggunaan dana), debitur fiktif, debitur topengan, dan rekayasa dokumen.
Kedua, KPK mengungkap masalah key person kredit yang tidak tercatat dalam kepengurusan atau sebagai pemegang saham pengendali (PSP) perusahaan. “Tiga BPD sampel mencatat empat kredit macet senilai Rp 260 miliar pada 2013–2020,” jelas Budi. Analisis kelayakan kredit lebih fokus pada profil key person, padahal mereka bukan pengurus perusahaan. Akibatnya, ketika key person bermasalah—misalnya meninggal—debitur justru menghentikan pembayaran.
Ketiga, termin pembayaran proyek tidak sampai ke bank. Lima BPD sampel mencatat 11 kredit macet senilai Rp 72 miliar (2013–2020). “Masalah ini kerap terjadi di sektor konstruksi,” papar Budi. Pertama, debitur secara sengaja mengalihkan rekening penerimaan pembayaran tanpa memberitahu bank. Kedua, bank gagal memblokir termin pembayaran yang masuk ke rekening penampungan. Terakhir, pihak bank justru mencairkan dana jauh melebihi progres pekerjaan yang seharusnya.
Lebih lanjut, KPK menduga kuat adanya kolusi aktif antara tiga pihak: debitur sebagai penerima kredit, bouwheer (pemberi pekerjaan), dan oknum pejabat BPD yang terlibat. “Pola ini menunjukkan kerjasama terstruktur untuk mengakali sistem perbankan,” tegas penyidik KPK.
Keempat, KPK menemukan debitur tidak layak namun tetap mendapat pembiayaan. Lima BPD menyalurkan enam kredit macet senilai Rp 224,7 miliar (2007–2022). “BPD mengabaikan karakter debitur, verifikasi usaha tidak ketat, dan mengesampingkan review risiko,” kritik Budi.
Kelima, jaminan kredit bermasalah tidak memadai. KPK menemukan jaminan kredit macet mencapai Rp 234,4 miliar selama periode 2007-2022 dengan tiga masalah krusial. Pertama, nilai jaminan justru lebih rendah daripada dana yang dicairkan. Kedua, debitur tidak menguasai jaminan tersebut. Ketiga, dokumen agunan tidak berada dalam penguasaan BPD.
Budi menegaskan, “Bank tidak melakukan penilaian jaminan secara berkala dan tidak mewajibkan agunan dimiliki oleh debitur atau pihak terkait.”
Keenam, KPK menyoroti moral hazard dalam Kredit Multi Guna (KMG) untuk anggota DPRD. Empat BPD menyalurkan Rp 20,867 miliar ke anggota DPRD Provinsi (2015–2024) yang kini macet. “Mereka enggan melunasi utang, terutama saat terkena Pergantian Antar Waktu (PAW),” sebut Budi. Meski PAW akibat kebijakan partai sudah dijamin asuransi, PAW karena alasan politik tidak tercakup. Selain itu, beberapa anggota DPRD yang tidak kena PAW juga menunggak. “Diduga, BPD kurang agresif menagih karena mereka bagian dari pemegang saham pengendali,” tandasnya.
Dengan temuan ini, KPK memperkuat kolaborasi dengan OJK untuk meminimalisir celah korupsi di sektor perbankan daerah.
